The article starts from the relationship between illegal Street Art and the crime of soiling (art. 639 of the Italian Penal Code) and proposes a rereading of the criminal law, in accordance with the principles derived from the Constitution, which identifies a limit to the configuration of the crime in the cultural value of the work of Street Art, without prejudice to the protection of private property pursuant to art. 2043 of the Italian Civil Code. The essay then focuses on civil and authorial profiles of Street Art, i.e. on the purchase of ownership of the Street Art work and after analyzing the different thesis, focuses on the placement of the Street Art work in a specific site, reconstructed as a free attribution in favor of a specific subject. The article continues addressing the problem of the interference between copyright and property right on the work and of the conflict between the artist and third parties, with regard to the reproduction of the works for the commercial purposes.
L’articolo affronta in primo luogo il problema del rapporto fra Street Art abusiva e reato di imbrattamento ex art. 639 c.p. e propone una rilettura della norma penale, alla luce dei principi ricavabili dalla Costituzione, che individui nel valore culturale dell’opera di Street Art un limite alla configurazione del reato, fermo restando la tutela della proprietà privata ex art. 2043 c.c. L’analisi si concentra, poi, sui profili civilistici e autoriali ossia sull’acquisto della proprietà dell’opera di Street Art, soffermandosi sulla collocazione dell’opera in un determinato sito, ricostruita come attribuzione gratuita a favore di un soggetto determinato, per poi affrontare i problemi dell’interferenza fra diritto d’autore sull’opera e diritto di proprietà sull’esemplare e del conflitto fra artista e terzi con riguardo alla riproduzione delle opere a fini commerciali
