L’esperienza della climate change litigation nei confronti delle imprese nel contesto europeo

Launched in the United States some twenty years ago, the climate change litigation targeting firms has now taken hold worldwide and is undergoing interesting developments in the EU as well. This paper begins by examining the most recent rulings issued by Courts in some Member States to investigate some of the problematic aspects of this kind of litigation. It also examines recent developments in EU directives on sustainability, seeking to understand the direction in which the uniform regulatory framework is evolving and how this evolution may facilitate or, conversely, hinder such initiatives.

Inaugurata negli Stati Uniti una ventina di anni fa, la climate change litigation che vede come destinatarie le imprese ha ormai preso piede in tutto il mondo e sta conoscendo interessanti sviluppi anche nella UE. Lo scritto prende avvio dall’esame delle più recenti pronunce emesse dalle Corti in alcuni Stati membri per indagare su alcuni aspetti problematici di tale tipo di contenzioso. Vengono anche esaminate le recenti vicende delle direttive eurounitarie sulla sostenibilità, cercando di comprendere in quale direzione il quadro normativo uniforme si stia evolvendo e come tale evoluzione possa agevolare o, invece, ostacolare tale tipo di iniziative.
