The lawyer’s professional service is based on intuitus personae, in particular on the trust placed by the client in his lawyer, both in and out of court. The lawyer must, therefore, on the basis of the mandate conferred on him, perform his services in compliance with specific duties. Among these, the duty of loyalty enjoys primary prominence, as it can manifest itself in various forms and declinations, also under the criminal law profile. Consider, first of all, the general principles of fairness and good faith, which must constantly inform the conduct of contracting parties. Among the further duties provided for by law, of primary importance is the duty to inform pursuant to Article 4, para. 3 of Legislative Decree No. 28/2010, failure to comply with which, on the part of the lawyer, is cause for the annulment of the legal aid contract, as well as a source of damages against one’s lawyer.
La prestazione professionale dell’avvocato si fonda sull’intuitus personae e, in particolare, nella fiducia riposta dal cliente nei confronti del proprio legale, tanto in ambito giudiziale, quanto in quello extraprocessuale. Il difensore deve, pertanto, sulla base del mandato conferito in suo favore, eseguire la propria prestazione nel rispetto di specifici doveri. Tra questi, l’obbligo di fedeltà gode di primario rilievo, potendosi manifestare in diverse forme e declinazioni, anche sotto il profilo penalistico. Si pensi, anzitutto, ai generali principi di correttezza e buona fede, che devono costantemente informare la condotta dei contraenti. Tra gli ulteriori doveri previsti ex lege, di primario rilievo è l’obbligo d’informativa ex art. 4, 3° comma, d.lgs. 4 marzo 2010, n. 28, la cui inosservanza, da parte del legale, è causa di annullabilità del contratto di patrocinio, oltre che fonte di risarcimento del danno nei confronti del proprio avvocato.
