Fragilidade e fragmentação do direito à saúde em tempos de pandemia

A emergência sanitária da covid-19 levou a uma crise sanitária, econômica e social que atingiu particularmente pessoas vulneráveis. O artigo examina, brevemente, a resposta dada pelo ordenamento jurídico para proteger pessoas vulneráveis, destacando como o próprio direito à saúde, que tem status constitucional, sofreu tensões e fragmentações internas até então inéditas.

The covid-19 health emergency has resulted in a health, economic and social crisis which has particularly affected vulnerable people. The contribution briefly examines the response offered by the Italian legal system with special regards to the protection of vulnerable subjects, highlighting how the right to health itself, which enjoys a constitutional status, has undergone unprecedented internal tensions and fragmentations.
