Formazione del giurista e class action. Il ponte del comparatista tra l’ideale ed il reale

This article aims to reconstruct the role played by legal education in determining the success of class actions. Since the peculiarities of civil law and common law systems inevitably impact the mindset of their jurists and the role they play in society and the systems themselves, the analysis begins with the specificities of the two major blocs and, in particular, the mindset of their protagonists. Indeed, their role is crucial in defining the success of certain instruments, as was the case with the US class action, whose flourishing is dependent—among other factors—on the specificities, mindset, and activism of the legal professions. Given this "multifactorial" nature of legal instruments, for class actions to develop within the Italian civil law context as well, it is crucial to invest in the (comparative) education of tomorrow's jurists.

L’articolo mira a ricostruire il ruolo giocato dalla formazione del giurista nel determinare il successo della class action. Poiché le peculiarità dei sistemi di civil law e di common law impattano inevitabilmente sulla mentalità dei loro giuristi e sul ruolo che essi rivestono nella società e nei sistemi stessi, l’analisi prende le mosse dalle specificità dei due grandi blocchi e, in particolare, del modo di pensare dei loro protagonisti. Il ruolo di questi, infatti, è nodale nel definire il successo di determinati strumenti, come è accaduto proprio nel caso della class action statunitense, la cui fioritura è tributaria – tra gli altri fattori – delle specificità, della forma mentis e dell’attivismo delle professioni legali. Tenuto conto di questa natura “multifattoriale” degli strumenti del diritto, affinché si possa avere anche nel contesto italiano di civil law uno sviluppo della class action, diviene cruciale investire su una formazione (comparatistica) del giurista del domani.
