This introduction sets out the focus of the special issue Migrants’ Religious Freedom in a Multilevel Legal System: Challenges and Perspectives in the Italian Context, which examines some of the legal and institutional challenges migrants encounter in exercising their right to religious freedom. These challenges often stem from administrative inefficiencies, fragmented legal frameworks, and a securitarian approach to migration policies. In Italy, they are particularly evident in the management of reception centres and administrative detention facilities, where public security concerns frequently override the protection of fundamental rights. The special issue examines key dynamics of the multilevel legal system, with particular attention to its interplay with European and international dimensions, and offers critical reflections on the challenges and opportunities for improving the protection of migrants’ religious freedom.
Questa introduzione presenta i temi affrontati nel numero speciale Migrants’ Religious Freedom in a Multilevel Legal System: Challenges and Perspectives in the Italian Context, dedicato alle sfide normative e istituzionali che i migranti affrontano nell’esercizio della libertà religiosa. Tali difficoltà derivano da carenze amministrative, frammentarietà del quadro normativo di riferimento, nonché dall’approccio securitario che spesso caratterizza le politiche migratorie. In Italia, queste criticità emergono in modo particolare nella gestione dei centri di accoglienza e delle strutture di detenzione amministrativa, in cui le esigenze di sicurezza pubblica tendono frequentemente a prevalere sulla garanzia dei diritti fondamentali. Questo numero speciale analizza le dinamiche del sistema giuridico multilivello in tale contesto, con particolare attenzione alle interazioni con le dimensioni europea e internazionale, proponendo alcune riflessioni critiche sulle principali sfide e sulle prospettive di tutela della libertà religiosa dei migranti.
