Abstract. — Climate protection represents a complex challenge for international law in the absence of effective institutions to ensure the protection of global public goods. In this context, the concept of the Common Concern of Humankind (CCH) is emerging as a key tool in the decisions of international courts. The European Court of Human Rights and the International Tribunal for the Law of the Sea appear to use CCH as presumption of fact concerning climate change.
