The note comments favorably on the Court of Justice’s judgement of 18 January 2024, in case c-218/22, Bu v. Comune di Copertino, through which the Luxembourg judges once again returned to the worker’s right to take advantage of paid annual leave. In particular, the Court of Justice, taking a different position from the one previously taken by the Italian Constitutional Court, recalled that, when the employment relationship has definitively ceased, paid holidays can and must be replaced by a financial allowance.
