The article considers the well-known difficulties of the national health system in effectively guaranteeing the right to health under conditions of equality, with serious repercussions on the most seriously ill and on their families, and questions, in reference to the debate on the opportunity to legalize medically assisted suicide, whether it is actually an expression of freedom of choice to direct these patients towards the "new" service consisting of assisted dying, leaving them to their "self-determination" and the complicity of certain family members. In reality, the level of civilization that should characterize a system that is inspired by constitutional values is measured on the basis of the care offered to serious patients, the disabled, the elderly or people who are simply alone, who, in the absence of services and a supportive attitude on the part of society, could suffer, as the Constitutional Court itself recalled in sentence no. 135/2024, an "indirect social pressure" and "become convinced that they have become a burden for their family members and for society as a whole, and thus decide to step aside prematurely".
L’articolo considera le note difficoltà del sistema sanitario nazionale a garantire effettivamente e in condizioni di uguaglianza il diritto alla salute, con gravi ripercussioni sui malati più gravi e sulle loro famiglie, e si domanda, in riferimento al dibattito sull’opportunità di legalizzare il suicidio medicalmente assistito, se sia effettivamente espressione di libertà di scelta indirizzare tali pazienti verso la “nuova” prestazione consistente nell’aiuto a morire, lasciandoli alla loro “autodeterminazione” e alla complicità di certi familiari. In realtà il livello di civiltà che dovrebbe caratterizzare un ordinamento che si ispira ai valori costituzionali si misura in base alle cure che si offrono ai pazienti gravi, ai disabili, agli anziani o alle persone semplicemente sole, le quali, in assenza di servizi e di un atteggiamento solidale da parte della società, potrebbero subire, come ha ricordato la stessa Corte costituzionale nella sent. n. 135/2024, una “pressione sociale indiretta” e “convincersi di essere divenute ormai un peso per i propri familiari e per l’intera società, e decidere così di farsi anzitempo da parte”.
