In this article, the authors delve into the creation and functioning of one of the key human rights oversight mechanisms within the United Nations system, specifically the Committees established by Human Rights Treaties. These Committees, tasked with interpreting and monitoring the implementation and compliance with treaty provisions by signatory States, play a critical role in safeguarding fundamental rights. However, the authors highlight the significant resistance shown by many States in effectively enforcing the measures issued by these Committees. Furthermore, the article examines the evolution of jurisprudence in countries like Spain, which has progressively recognized the binding and enforceable nature of the Committees’ decisions, thereby solidifying a legal doctrine that legitimizes their authority and applicability within national legal frameworks.
