The paper examines the most relevant profiles of the legislative decree n. 175/2016 regarding the limits set to decrease the State-shareholding phenomenon. The focus of the study is on the effectiveness over time of such strict limits, the related contradictions and the possible interpretative and legislative solutions.
Il contributo esamina gli aspetti più rilevanti del decreto legislativo n. 175/2016 in riferimento ai limiti introdotti per ridurre il fenomeno delle partecipazioni pubbliche. Lo studio si concentra sulla tenuta nel tempo di limiti così stringenti, sulle relative contraddizioni e sulle possibili soluzioni interpretative e normative.
