Art. 52(3) of the Charter of Fundamental Rights provides that the scope of the rights protected by the Charter may not be narrower than that granted to the same rights by the European Convention on Human Rights. The judgments Centraal Israëlitisch Consistorie van België (Court of Justice [GS], case C-336/19, judgment of 17 December 2020) and van de Moslims van België (European Court of Human Rights, app. no. 16760/22, judgment of 13 February 2024) demonstrate that the criterion provided by Art. 52(3) of the Charter may, in certain limited cases, hamper the protection of primary interests of the Union. This would happen if a right protected by both the Charter and the Convention had to be balanced with a value to which only Union law accords paramount importance.

Abstract

Art. 52(3) of the Charter of Fundamental Rights provides that the scope of the rights protected by the Charter may not be narrower than that granted to the same rights by the European Convention on Human Rights.
