Pubblica amministrazione e trasformazioni della giustizia amministrativa

The essay traces the evolution of administrative justice over the past three decades. It first reconstructs what that system was like in the early 1990s and points out how the process before the administrative judge did notmeetthe citizen’s protection needs. It then traces legislative changes and major pronouncements by the Constitutional Court and administrative judges up to the 2010 Code of Administrative Procedure. It analyzes the subsequent evolution to the present day highlighting some critical issues that would also require constitutional amendments to be resolved.

Il saggio ripercorre l’evoluzione della giustizia amministrativa nell’ultimo trentennio. Ricostruisce anzitutto com’era tale sistema all’inizio degli anni Novanta del secolo scorso e sottolinea come il processo innanzi al giudice amministrativo non soddisfaceva le esigenze di tutela del cittadino. Ripercorre poi le modifiche legislative e le principali pronunce della Corte costituzionale e dei giudici amministrativi fino al Codice del processo amministrativo del 2010. Analizza l’evoluzione successiva fino ai giorni nostri mettendo in evidenza alcune criticità che per essere risolte richiederebbero anche modifiche costituzionali.
