L'integrazione europea come storia costituzionale. Profili didattici

The article proposes an interpretation of the didactics of European constitutional history centred on three fundamental thematic axes. The first concerns the process of incremental constitutionalisation, with its limits and aporias. In fact, since the creation of the ECSC in 1951, an increasing intertwining of an internationalist pole and a constitutionalist pole has developed, with variable, multiform combinations and varying degrees of effectiveness. The second concerns the attempts (from the experience of the ad hoc Assembly in 1952-53 to that of the European Convention at the beginning of the new century) to give the Communities and the Union a more solid political-constitutional nature, and the reasons for their lack of success. Finally, the relationship between national constitutional systems and European choices is considered, in the sense of both how much the former have affected the latter, and how the latter have in turn reverberated on the former.

L’articolo propone una lettura della didattica della storia costituzionale europea incentrata su tre assi tematici fondamentali. Il primo riguarda il processo di costituzionalizzazione incrementale, con i suoi limiti e le sue aporie. A partire dalla nascita della CECA, nel 1951, si è infatti venuto sviluppando un crescente intreccio tra un polo internazionalistico e un polo costituzionalistico, con combinazioni variabili, multiformi e dal differente grado di efficacia. Il secondo concerne i tentativi (dall’esperienza dell’Assemblea ad hoc degli anni 1952-53 a quella della Convenzione europea all’inizio del nuovo secolo) di conferire alle Comunità e all’Unione una natura politico-costituzionale più solida, e le ragioni del loro mancato successo. Infine viene preso in considerazione il rapporto tra i sistemi costituzionali nazionali e le scelte europee, nel senso sia di quanto i primi abbiano inciso sulle seconde, sia di come le seconde si siano a loro volta riverberate sui primi.
