Earth Observation data have an important role to play in understanding various processes affecting our planet and in monitoring climate and environmental change, risk detection and prevention. Space technologies and EO data can make a crucial contribution to the pursuit of the 2030 Agenda's Sustainable Development Goals. The problem of environmental protection arises in all its evidence and at all levels, from Earth to Space. In the paper, it will be interesting to assess the suitability of existing legislation to safeguard the rights of the individual to a healthy environment, the right to health, the right to life, and the right to non-discrimination. Consideration will be given to the appropriateness of talking about the rights of nature and animal rights today. Constitutional Law No. 1/2022 amended Articles 9 and 41 of the Constitution. It recognised the value of environmental protection, by virtue of the principle of sustainable development. It provides for a general criterion for action by public authorities to protect the environment. The perspective is broadened to include the role of private individuals, whose economic initiative cannot be carried out to the detriment of health and the environment. The law can direct and coordinate economic initiative towards social and environmental ends. The paper will take a closer look at legislation at the international level, focusing on the presence of binding limits on private economic initiative. There are no binding regulations. There is the 2030 Agenda, which is a political instrument and not a normative one. Furthermore, it would be interesting to be able to include the space environment in the concept of environment. Looking at the international regulations on space activities, there does not seem to be an express ban on pollution of outer space and an obligation to protect the environment.
Gli Earth Observation data hanno un ruolo di indiscutibile rilievo per la comprensione di svariati processi che interessano il nostro Pianeta e per le attività di monitoraggio del cambiamento climatico e ambientale, di rilevamento e prevenzione del rischio. Le tecnologie spaziali e gli EO data possono contribuire in maniera determinante al perseguimento degli Obiettivi di sviluppo sostenibile dell’Agenda 2030. Il cambiamento climatico e i suoi effetti è ormai certificato da serie storiche di dati disastrosi. Il problema della tutela dell’ambiente si pone in tutta la sua evidenza e a tutti i livelli, dalla Terra allo Spazio. Nel paper sarà interessante valutare l’idoneità della normativa esistente a salvaguardare i diritti dell’individuo ad un ambiente salubre, diritto alla salute, diritto alla vita, diritto alla non discriminazione; ma non solo. Si considererà l’opportunità di parlare oggi di diritti della natura e di diritti degli animali. La legge costituzionale n. 1/2022 ha modificato gli articoli 9 e 41 della Costituzione. Essa ha riconosciuto il valore della tutela dell’ambiente, in forza del principio dello sviluppo sostenibile. Si prevede un criterio generale di azione dei pubblici poteri improntato alla protezione dell’ambiente. Si allarga la prospettiva al ruolo dei privati, la cui iniziativa economica non può svolgersi danneggiando la salute e l’ambiente. La legge può indirizzare e coordinare l’iniziativa economica verso fini sociali e ambientali. Il paper approfondirà la normativa a livello internazionale, focalizzando l’attenzione sulla presenza di limiti vincolanti all’iniziativa economica dei privati. Non vi sono norme vincolanti. C’è l’Agenda 2030, che è però uno strumento politico e non normativo. Inoltre, sarebbe interessante poter comprendere nel concetto di ambiente, anche l’ambiente spaziale. Guardando la normativa internazionale in tema di attività spaziali, non parrebbe sussistere un divieto espresso di inquinamento dello spazio extraatmosferico e un conseguente obbligo di protezione dell’ambiente.
