The system designed by Sharia’h appears to be socially widespread, at least according to Western jurists. Its circulation occurs through the movement of the instruments that arise in accordance with it. In this context, the Sciariatic model can be conceptualised as a metamodel of economics and finance. It is not possible to export this model in abstract terms; rather, it must be understood through its institutions. The cultural approach presupposed is at least distinct from the prevailing idea of the market. It arises in a cultural and legal dimension that is distant from that in which market discipline responds to economic efficiency. Nevertheless, the Islamic model is also based on private property, price determination through the meeting of supply and demand, as well as profit. However, it has manipulated its legal instruments to design economic-contractual structures that allow certain profit to be achieved without the use of the interest rate, in a manner similar to the conventional system. The incompatibility of the “different” model with purely economic and governance assumptions has therefore led to the unacceptable result of renouncing one’s identity.
Il sistema disegnato dalla Sharia’h appare socialmente diffuso all’Occidente. La sua circolazione avviene mediante il movimento degli strumenti che nascono in conformità ad essa. In questo senso, quello sciaraitico si configura come un metamodello di economia e finanza, non esportabile in materia astratta, ma attraverso i suoi istituti. Essi presuppongono un approccio culturale quantomeno altro dall’idea di mercato imperante, nascendo in una dimensione culturale e giuridica piuttosto lontana da quella in cui la disciplina del mercato risponde a parametri di efficientismo economico. Cionondimeno, anche il modello islamico si fonda sulla proprietà privata, sulla determinazione del prezzo tramite domanda e offerta, nonché sul profitto. Tuttavia, esso ha manipolato i propri strumenti giuridici per disegnare strutture economico-contrattuali che permettono di conseguire profitto certo senza l’utilizzo del tasso d’interesse al pari del sistema convenzionale. L’incompatibilità del modello “diverso” con assunti meramente economici e di governance ha comportato, dunque, il risultato non accettabile di rinuncia alla propria identità.
