Drawing on two recent US Supreme Court decisions (SFFA and Biden v. Nebraska), the article discusses some of the problems and contradictions associated with the interpretation of the principle of equality in the field of higher education. The first part discusses affirmative action in the light of critical race theory; the second part examines the 'meritocracy trap' debate; and the third part analyses the judicial/administrative conflict over student debt relief measures. The introduction and conclusion situate these issues within the broader framework of struggles for a more social constitution in which education, labour and democracy are intertwined.
