Rileggere Salvatore Pugliatti, «Esecuzione forzata e diritto sostanziale»

With a new reading of Salvatore Pugliatti’s work “Enforcement Procedure and Substantive Law”, the Author compares the past and present of the enforcement procedure, in the light of the most recent innovations made by the so-called Cartabia reform. Starting from the assimilation between expropriation for public utility and forced sale (which today encounters more than one interpretative diffculty), the Author investigates the nature and effects of forced sale, also referring to indirect enforcement means and to the relation between individual and insolvency procedures.

Rileggendo l’opera monografica di Salvatore Pugliatti “Esecuzione forzata e diritto sostanziale”, l’Autore pone a confronto passato e presente del processo esecutivo, con particolare riguardo alla vendita forzata, anche alla luce delle più recenti novità normative di cui alla c.d. riforma Cartabia. Muovendo dalla assimilazione – cara al Maestro – tra espropriazione per pubblica utilità e vendita forzata (la quale oggi incontra più di una difficoltà interpretativa), si passa ad indagare natura ed effetti della vendita forzata, con cenni anche all’esecuzione indiretta e al raffronto tra esecuzione individuale e concorsuale.
