Il trust discrezionale inter vivos con effetti post mortem. Tutela dei legittimari, azione di riduzione e legittimato passivo

The present work attempts to analyse the relationship between an action for reduction and an action for nullity in respect of a discretionary inter vivos trust with post-mortem effects. In particular, starting from an axiological-systematic perspective, the three relevant issues that emerge from the court decision are addressed: the qualification of such a trust in the indirect gift; the relationship with the reduction action in the matter of protection of the injured legitimary, its real or non-real effectiveness and the identification of the legitimated passive; the reiterated exclusion of the applicability of Article 549 of the Civil Code to inter vivos acts.

Con il presente lavoro si prova ad analizzare la relazione dell’azione di riduzione e azione di nullità nei confronti di un trust discrezionale inter vivos ad effetti post mortem. In particolare, muovendo da una prospettiva assiologica-sistematica si affrontano le tre questioni rilevanti che emergono dalla decisione giudiziale: la qualifica di tale trust nella donazione indiretta; la relazione con l’azione di riduzione in materia di tutela del legittimario leso, la sua efficacia reale o meno e l’individuazione del legittimato passivo; la ribadita esclusione dell’ammissibilità applicativa dell’art. 549 c.c. agli atti inter vivos.
