In the criminal trial, the equality to be pursued is not only the equality of citizens before the law (“the law is the same for everyone”), guaranteed by the principle of legality and the principle of mandatory prosecution, but also the equality of the parties before the judge (Article 111, paragraph 2, Const.). Two recent legislative reforms, one already enacted and the other still under discussion, suggest some reflections on these two different aspects of the principle of equality.
