The raise and progresses of golden powers depend on economic factors, which in-evitably produce effects on the law. In this context, Regulation (EU) 2019/452 de-termines a concrete shift of paradigm. However, the boundaries of EU lawmakers’ intervention with regard to the screening of foreign investments remain uncertain. Among the different solutions adopted by EU Member States, this study under-lines the relevance of the Italian approach in showing that even though the law must adapt to the instances of the economy, it is also necessary that the law itself governs the market.
