The aim of the paper is to outline the contours of the cross-class cram-down mechanism, which only apparently relates to the approval of the confirmation of reorganization plan; in reality, the discipline of the cross-class cram-down is fully within the scope of the so-called “distributive question”, representing a non-secondary component of the system governing the manner of allocation, among several claimants, of the economic value of the insolvent firm.
