Criteri giurisprudenziali oggettivi e soggettivi nella disciplina dei legata vinorum: tra corpora certa e corpora incerta

The work focuses on how the Romans created wine legacies. Thus, the objective and subjective criteria developed by jurists are reviewed and analysed.In particular, the contribution of Sabinus in devising criteria for assessing what is vinum is analysed, and then how the thinking of Ulpianus and later jurists contributed to the cause. An attempt will thus be made to understand whether any aspect was left to the subjectivity of the testator, or whether jurisprudence had analysed specific indicators. In order to give an explanation to the many questions, the fungibility of the res legate in relation to the legate of future and periodic wine will also be investigated.
