«The unity of the damage to the person is based precisely in its unitary value», by virtue of which the individual becomes the holder of the most disparate in terests. The evolution of the damage, starting from the subjective moral damage up to the existential damage, passing from the biological damage, has revealed the relevance of prejudicial aspects of the injury with reference not only to the productive sphere of the subject, «but also to the spiritual, cultural, emotional, social, sporting one and to any other area in which an individual’s personality develops». Therefore, if the «project of life» encompasses the essence of the person, in the perspective of its unity, in the event of damage to the same, a constitution ally oriented reading of the rules would allow the application not of art. 2059 of the Italian Civil Code, but directly the art. 2043 of the Civil Code, since it is in the «injustice of damage» that the law provides for compensation.
L’unitarietà del danno alla persona trova fondamento proprio nel suo valore unitario», in forza del quale l’individuo diventa centro di imputazione dei piú disparati interessi. L’evoluzione del danno, a partire dal danno morale soggettivo fino al danno esistenziale, passando dal danno biologico, ha svelato la rilevanza di aspetti pregiudizievoli della lesione con riferimento non solo alla sfera produttiva del soggetto, «ma anche a quella spirituale, culturale, affettiva, sociale, sportiva e ad ogni altro ambito in cui svolge la personalità un individuo». Se quindi il «progetto di vita» racchiude l’essenza della persona, nell’ottica della sua unitarietà, in caso di danno alla medesima, una lettura costituzionalmente orientata delle norme permetterebbe di applicare non l’art. 2059 c.c., ma direttamene l’art. 2043 c.c., poiché è nell’«ingiustizia del danno» che la legge prevede il risarcimento.
