The article deals with the use of the concept of sovereignty as a legal argument by constitutional tribunals of some EU member states (France, Germany and Italy). It explores how the concept of sovereignty has been replaced by that of constitutional identity and which is the meaning of the latter in the three different constitutional cultures.
