The essay examines the administrative judge’s use of preparatory materials of statutory law as an aid to interpretation. The essay preliminarily observes, reversing the perspective, that often, statures transpose and reworks jurisprudential materials. Administrative law is traditionally characterised as jurisprudential law that also benefits from the contributions of doctrine. Among the preparatory materials of the statutes, the administrative judge often takes into consideration parliamentary acts and sometimes also the recitals of European directives and the reports of the Competition and Market Authority. Regulatory impact analysis, on the other hand, concerns the regulatory acts of independent authorities

Il saggio esamina l’utilizzo da parte del giudice amministrativo dei materiali preparatori della legge come ausilio all’interpretazione. Il saggio osserva preliminarmente, rovesciando la prospettiva, che spesso, è in realtà la legge che recepisce e rielabora i materiali giurisprudenziali. Il diritto amministrativo si connota tradizionalmente come diritto giurisprudenziale che beneficia anche dei contributi della dottrina. Tra i materiali preparatori della legge, il giudice amministrativo prende spesso in considerazione gli atti parlamentari e talora anche i considerando delle direttive europee, le segnalazioni dell’Autorità garante della concorrenza e del mercato.
