Lettera e legge. Il problema dell'interpretazione e del confine tra potere legislativo e potere giudiziario

The article concerns the problem of the methods of interpretation of the law and, in particular, the issue of interpretation that differs from the letter. The theme involves essential issues of the general theory of law as it refers to the boundary between the legislative power and the judiciary. Starting from a review of the current orientations in jurisprudence, a critical investigation of the arguments put forward in support of the meta-literal interpretation is carried out.

Il saggio ha ad oggetto il problema dei metodi d’interpretazione della legge e, in particolare, il tema della interpretazione difforme rispetto alla lettera. Il tema convoca questioni essenziali della teoria generale del diritto in quanto ruota intorno al confine tra il potere legislativo e il potere giudiziario. Muovendo da una ricognizione degli orientamenti correnti nella giurisprudenza, è svolta una indagine critica delle argomentazioni poste a sostegno della interpretazione meta-letterale.
