Quota di legittima e quota di eredità. Gli effetti dell’azione di riduzione

The essay, moving on the assumption that there is a difference between the share of inheritance and the share of reserved assets or legitimate share, proposes a criterion aimed at determining the share of inheritance of the legitimate acting in reduction and, correspondingly, the share of the other competing heirs. From this premise, the effects of the reduction action are investigated and in the light of the reconstruction carried out, it is concluded that the reduction action produces the following effects: a) ascertainment of the quality of legitimacy; b) ascertainment of the injury; c) redefinition of the shares of inheritance; d) ruling on the ineffectiveness of the injurious provision. On the basis of this reconstruction, it is reiterated that the reduction action has the immediate and direct effect of rendering the injurious provision ineffective. The acquisition by the lawful owner, on the other hand, takes place by virtue of the inheritance share, as redetermined, as a result of the reduction action. According to this reconstruction, the judgment of reduction does not determine a merely relative ineffectiveness, but an absolute ineffectiveness. In any case, it is intended to make it clear that, even if we follow the position of traditional doctrine, it is inevitable that the reduction ruling will lead to a recalculation of the inheritance shares.

Il saggio, movendo dal presupposto che esiste una differenza tra quota di eredità e quota di patrimonio riservato o quota di legittima, propone un criterio volto a determinare la quota di eredità del legittimario che agisce in riduzione e, corrispondentemente, la quota degli altri eredi che concorrono. Da questa premessa si indagano gli effetti propri dell’azione di riduzione e alla luce della ricostruzione svolta si conclude che l’azione di riduzione produce i seguenti effetti: a) accertamento della qualità di legittimario; b) accertamento della lesione; c) ridefinizione delle quote di eredità; d) pronunzia della inefficacia della disposizione lesiva. Sulla base di questa ricostruzione si ribadisce che l’azione di riduzione ha per effetto, immediato e diretto, la inefficacia della disposizione lesiva e che l’acquisto da parte del legittimario avviene proprio in forza della quota ereditaria per come rideterminata, per effetto dell’azione di riduzione. Secondo questa ricostruzione, la sentenza di riduzione non determina una inefficacia meramente relativa, ma una inefficacia assoluta. In ogni caso, si intende chiarire che, anche a voler seguire la posizione della dottrina tradizionale, è inevitabile che la sentenza di riduzione determini una rimodulazione delle quote ereditarie.
