The essay analyzes the main transformations that are characterizing the legal approach to environmental protection in the context of the ecological transition. In the light of the European Green Deal and the EU Next Generation and taking into account the effects of the amendments to articles 9 and 41 of the Italian Constitution, the article examines the main challenges facing the public authorities for the government of the ecological transition, both from the point of view of the relationship between State and market, and from the point of view of the administrative organization and public decisions.
