The essay analyses the public regulation of the volunteering system achieved with the “Italian Code of the third sector”. It dwells in particular on the innovative vision of the relationship between the State and the citizen and between the State and the market, elaborated by the Code by enhancing the spontaneous organizations of civil society. It then analyses the counterbalance of this vision, which consists in subjecting the system to a more intense public regulation

Il saggio analizza la regolazione pubblica del settore del volontariato realizzata con il codice del terzo settore. Si sofferma in particolare sulla visione originale dei rapporti tra Stato e cittadino e tra stato e mercato elaborata dal codice, valorizzando le organizzazioni spontanee della società civile. Analizza poi il contrappeso di tale visione, che consiste nella sottoposizione a una disciplina pubblicistica più intensa del sistema
