La pianificazione paesaggistica della regione Toscana tra legislazione nazionale e giurisprudenza amministrativa

Abstract [engl.]: the work is the product of a scientific research study on the protection of the landscape by means of territorial planning. The planning policies of the Tuscany Region embody awareness of structural invariants that consider the ground surface in terms both of the environmental and biotic aspects and of the morphological characteristics and the nature of urban and rural contexts. The balance between the interests of the landscape in general on the one hand and local public interests and the rights of private individuals on the other, has been treated in varying ways by the differing administrative judges. The theme leads to various considerations as to the right for natural beauty to be included within the Italian system.

Abstract [it.]: il lavoro è frutto di una ricerca scientifica sulla tutela del paesaggio mediante pianificazione territoriale. Le scelte pianificatorie operate dalla regione Toscana esprimono sensibilità per invarianti strutturali che considerano il suolo sia per gli aspetti ambientali e biotici sia per i caratteri morfologico-identitari dei contesti urbani e rurali. L’equilibrio tra gli interessi paesaggistici generali, da una parte, e gli interessi pubblici locali e i diritti dei privati, dall’altra, è stato variamente trattato dai giudici amministrativi. Il tema conduce a qualche considerazione sul diritto alla bellezza nell’ordinamento italiano.
