La risoluzione 76/262 dell’Assemblea generale sulla psicanalisi del potere di veto

It may have taken the war in Ukraine to get the veto power of the permanent members of the Security Council to "take seriously", but what is even more surprising is the recent adoption by consensus of resolution 76/262 ("Standing mandate for a General Assembly debate when a veto is cast in the Security Council ") by the General Assembly in a moment of profound division of the international community, especially since many have spoken of a historic passage in an attempt to limit what I have defined it as "the heaviest legal-historical legacy of the twentieth century". But are we really sure that this is actually the case?

C’è forse voluta la guerra in Ucraina per far “prendere sul serio” il potere di veto dei membri permanenti del Consiglio di sicurezza, ma quello che sorprende ancora di più è la recente adozione per consensus della risoluzione 76/262 (“Standing mandate for a General Assembly debate when a veto is cast in the Security Council”) da parte dell’Assemblea generale in un momento di profonda divisione della comunità internazionale, tanto più che molti hanno parlato di un passaggio storico nel tentativo di limitare quello che più volte ho definito come la più pesante eredità storico-giuridica del XX secolo. Ma siamo proprio sicuri che sia effettivamente così?
