On September 4, 2020 Serbia and Kosovo signed the Economic Normalization Agreement, also known as the «Washington Agreement». The form of the Washington Agreement is peculiar: it is embodied in two different copies, separately signed, which do not have identical texts. Looking at these formal and procedural aspects, authors claimed that documents signed in Washington by Serbia and Kosovo do not express the common intention of the two States, so they do not constitute an international agreement. Other scholars, noting the ambiguous language of the text, argue that the Washington Agreement is a political agreement rather than a legally binding document. The present article aims at contributing to this scientific discussion by proposing unconventional solutions to the issues concerning the form and the legal nature of the Washington Agreement.
