The Banking Union regulates the banking authorisation as an essential instrument for the European market achievement and the European financial system stability protection. The Author investigates the regulatory framework regarding the prudential requirements and procedure for the access to the activity of credit institutions in Italy. The aim is to analyse the level of integration between the Union law and the national legislation and to highlight which limitations should apply to the supervisory Authorities’ discretionary powers when assessing a request for banking licence.
