The purpose of this paper is analyze the possibility of using the Arbitration as an extrajudicial form of solving individual labor conflits as established by Labor Reform, also observing what the Italian legislation presents on this subject. About the methodological aspects, the dialectical method was used, through exploratory research, using also the bibliographic bases. This work concluded that the Italian legislation is more concerned with the setting of an arbitration clause, as well as a restriction on the discussion on contractual termination, which is evidence of the precautionary principle in preserving the protective principles inherent in labor law.
