One of the most significant decisions on intellectual property rights is undoubtedly that of 1908 concerning parody in the D’Annunzio-Scarpetta case, won by Eduardo Scarpetta and famous not only for the renown of the parties, but also for the echo it aroused in Italy and Europe. The author follows the trial’s development, focusing on the legislator’s attention to parody, which dates back to the early twentieth century with several projects to reform the Italian law of 1865- 1882. The decision had a remarkable success in subsequent case law and in artistic representations, as in the recent movie by Mario Martone that gives due credit to the trial and to the value of the legal configuration of parody
