The paper deals with the evolution of the legal science between the 15th and the 16th centuries with regard to the clause sola facti veritate inspecta, which belonged to the field of summary procedure and was introduced towards the end of the 14th century. One effect of such clause upon the procedure is particularly taken into account, that is the possibility it gave the judge to pronounce a decision founded on different points from those presented in the plaintiff’s petitio.
