L'incerto destino degli embrioni soprannumerari

The essay analyzes the latest Constitutional Court judgments on medically assisted procreation. The unconstitutionality of the embryo selection crime if to the purpose to avoid the transfer of embryos with serious genetic disease and the confirmation of the illegitimacy of the prohibition - in any case - of their deletion, puts the author before the question of the fate of supernumerary frozen embryos. The author experiments balancing hypothesis between all the interests involved, in particular the interest of the embryo to be part of a procreative project, albeit different from that initial, and the general interest in scientific research, especially if with genetic material incompatible with life

Il saggio analizza gli ultimi interventi della Consulta in tema di procreazione medicalmente assistita. La declaratoria d’incostituzionalità della disposizione che configura come ipotesi di reato la selezione di embrioni seppur finalizzata ad evitare il transfert di quelli affetti da malattie genetiche gravi, a fronte della conferma dell’illegittimità del divieto – in ogni caso – della loro soppressione, pone l’autore dinanzi all’interrogativo della sorte che attende i c.dd. soprannumerari. Vengono così sperimentate ipotesi di bilanciamento tra tutti gli interessi coinvolti, valutando in particolar modo sia l’interesse dell’embrione a essere comunque parte di un progetto procreativo, anche se diverso da quello iniziale, e l’interesse generale alla ricerca scientifica, specie là dove realizzabile con materiale genetico incompatibile con la vita
