La cassazione e il suo nuovo volto. Elogio dell’oralità

The article discusses the consequences of the 2012 reform of the trial before the Italian Corte di Cassazione. The Legislative decree n. 83/2012 modified the article 360 of the Italian code of civil procedure, which in the new version no longer permits to chal- lenge the judgment by the Court of Appeal for its «insufficient» or «contradictory» motivation, but only for its «absence». The plenary session («Sezioni Unite») of the Cassazione issued an interpretative decision (n. 8053, 7.04.2014) on the requisite of the «absence» of the motivation, which (in the opinion of the Cassazione) occurs only when a crucial fact is not taken into account, this way determining a different issue of the case. The author critically discusses the issues stemming from the disappearing of the control on the adequacy of the motivation by the Corte di Cassazione and the new rules of the trial before the Court.
