Il Parlamento durante l'emergenza Coronavirus. Alcuni spunti dal caso spagnolo

The present paper is an investigation on the measures taken by the Parliament of the States affected by the virus COVID-19 to continue performing their tasks during this public health crisis and any future emergency. The study has its roots in the analysis of the solutions suggested by the Camera dei deputati and the Senato della Repubblica of the Italian Republic, from which it moves towards the investigation of alternative answers brought into being by the legal doctrinaire discussion. Furthermore, in the study, there will be a focus on how the Spanish Government and Parliament have been employing – in order to manage the crisis – some instruments that are nonexistent in the Italian set of laws but that may serve as a model for Italy.

Il presente contributo muove da una riflessione sulle misure che garantiscono la prosecuzione dei lavori parlamentari durante le emergenze e, nel caso di specie, come la crisi sanitaria provocata dal virus COVID-19 ha inciso sulle attività dei Parlamenti degli Stati interessati dal contagio. Lo studio muoverà dall’analisi delle soluzioni messe in campo dalla Camera dei Deputati e dal Senato della Repubblica italiani per poi vagliare le ipotesi, alternative a quest’ultime, ventilate nel dibattito dottrinario in atto. Si analizzerà come il Parlamento ed il Governo spagnolo abbiano impiegato – per la gestione della crisi sanitaria – strumenti che, sconosciuti all’ordinamento italiano, potrebbero essere dallo stesso imitati.
