The essay deals with the issue of the civil sanction (nullity) in the acts on illegal buildings and the related profiles, with particular regard to circulatory conflicts. Starting from the criticism and the consequent overcoming of the recent jurisprudential thesis about the textual nullity, it come to propose an alternative reconstruction, in terms of absolute ineffectiveness of the act.
Il saggio affronta il tema della sanzione civile (nullità) agli atti negoziali di immobili abusivi ed i profili ad essa connessi, con particolare riguardo ai conflitti circolatori. Partendo dalla critica e dal conseguente superamento della recente tesi giurisprudenziale della nullità testuale si giunge a proporre una ricostruzione alternativa, in termini di inefficacia assoluta dell’atto.
