Staaten- o Verfassungs-Verbund. Appunti su alcune “immagini” del BVerfG e sulle relative implicazioni territoriali

The article analyses the genealogy and meaning of the phrase Staaten-, Verfassungs-, Verwaltungs- und Rechtsprechungsverbund, used by the German Constitutional Tribunal in recent case-law and, lately, in the PSPP judgment. It also examines its spatial implications. In particolar, the essay reads the expression as a synthesis of Staatenverbund, Verfassungsverbund and Verfassungsgerichtsverbund, showing the inner tension between democratic territoriality and market, universality and particularity of rights.

L’articolo analizza la genealogia e il significato della formula Staaten-, Verfassungs-, Verwaltungs- und Rechtsprechungsverbund, impiegata dal Tribunale costituzionale tedesco nella giurisprudenza recente e, da ultimo, nella sentenza sul PSPP, indagandone le implicazioni spaziali. In particolare, la interpreta come una sintesi di Staatenverbund, Verfassungsverbund e Verfassungsgerichtsverbund, mostrando la tensione tra territorialità democratica e mercato, universalismo e particolarismo dei diritti.
