Tipicità e atipicità delle disposizioni testamentarie

The distinction between «tipicità» and «atipicità», therefore, does not actually reverberate in the identification of the discipline applicable to the specific case.

La diversità delle disposizioni testamentarie spiega perché il testamento non è soltanto l’atto con il quale il testatore dispone delle proprie sostanze. Il contenuto del testamento risulta aperto a qualsivoglia disposizione, sia avente disciplina che non, purché meritevole e ragionevole, in conformità ai valori fondamentali dell’ordinamento. La distinzione tra tipicità e atipicità, quindi, non si riverbera effettivamente nell’individuazione della disciplina applicabile al caso concreto.
