The article deals with the issues of the significance and the extent of a mandatory right of the European worker: the right to annual laves. Indeed, this right is firmly stated in the «European Charter of Fundamental Rights», art. 31, and in the Directive 2003/88, art. 7. Those rules were considered enunciating rules of European’s Union social law of particular importance, but having been formulated in a concise manner, they could only be clarified through a significant number of interpretative judgements of the Court. In fact it is only thanks to the Court’s case-law that it was possible to clearly identify the periods of work to be counted for the purposes of accrual of the right. In particular it has been established that between those periods should be considered those during which the worker benefited from sick leave or maternity leave (but not parental leave). The article highlights that on the other hand, periods of ‘non-working time’ that are dependent on structural, foreseeable or voluntary reasons, cannot be counted for the accrual of the right to leave.
L’articolo affronta le questioni della portata e dell’estensione di un diritto irrinunciabile del lavoratore europeo: quello alle ferie annuali. In effetti tale diritto viene affermato in maniera perentoria nella «Carta europea dei diritti fondamentali», all’art. 31, e nella Direttiva 2003/88, all’art. 7, norme che sono state considerate enunciare «un principio particolarmente importante del diritto sociale dell’Unione», ma che essendo state formulate in maniera sintetica hanno potuto essere precisate solamente attraverso un copioso numero di sentenze interpretative della Corte. In effetti è solo grazie alla giurisprudenza della Corte che si è potuto individuare con chiarezza quali fossero i periodi di lavoro da conteggiare ai fini della maturazione del diritto, ed in particolare che in tali periodi vi dovessero rientrare quelli durante i quali il lavoratore ha usufruito di congedi per malattia o per maternità (ma non i congedi parentali). L’articolo evidenzia che invece non possono essere conteggiati tra i periodi da conteggiare ai fini della maturazione del diritto alle ferie i periodi di tempo di ‘non lavoro’ che siano dipendenti da motivazioni strutturali, prevedibili o volontarie. L’articolo affronta infine i temi della corretta quantificazione dell’indennità finanziaria che il lavoratore ha diritto a percepire durante il periodo di ferie e quali siano gli effetti che la normativa europea può produrre sul diritto interno.
