The issue deals with constitutional review with regard to the protection of the labour rest on Sunday and public holidays, guaranteed by the Basic Law by virtue of the reference to Article. 139 of the Weimar Constitution, which is thus "an integral part of the constitutional text" and "is not placed on a step lower than the other articles of the Basic Law" (BVerfGE 19, 219).

Il contributo ricostruisce la giurisprudenza costituzionale tedesca con riguardo alla tutela del riposo della domenica e dei giorni festivi, garantito dalla Legge Fondamentale in forza del richiamo all’art. 139 della Costituzione di Weimar, che costituisce così «parte integrante del testo costituzionale» e «non si colloca su un gradino inferiore rispetto agli altri articoli della Legge Fondamentale » (BVerfGE 19, 219).
