Procreazione assistita: limiti e contraddizioni di una legge al vaglio dei referendum

The article submitted to critical observation the most important provisions of the law on medically assisted procreation (l. 40/2004), verifying, in particular, compatibility with constitutional principles. The analysis sheds light on more than one profile of problematic legislation on assisted reproduction, leading to detect, in many respects, the unreasonableness or contradictory. It should be noted, in this regard, the important task of constitutional jurisprudence to identify trouble spots and profiles of dubious constitutionality of the law, indicating to the legislature the way for a possible corrective action The essay deals also with the issue of legal capacity of the embryo and of prenatal life’s protecion apart from the attribution of legal capacity of the unborn child .

L'articolo analizza le principali disposizioni della legge in materia di procreaziome medicalmente assistita (legge 40/2004), oggetto di referendum abrogativo, ponendo in evidenza l'irragionevolezza, l'incongruenza e anche l'inapplicabilità di tale normativa .
