In Italy, however, they have not yet found a wide application, but have been looked upon by the legislature and the legal science gradually with interest. The analysis of the institution of the public inquiry is divided into three parts. In the first, it is treated the operating model of public inquiries in the UK, with reference to participatory tools in the process of localization in the formation of public works and urban planning. In the second part, has rebuilt the discipline of enquêtes publiques in the French administrative system
L’istituto dell’inchiesta pubblica costituisce, nel diritto amministrativo, una peculiare figura procedimentale adottata in settori dove l’attività istruttoria è particolarmente complessa e le esigenze partecipative sono maggiormente avvertite. Nate in Gran Bretagna e in Francia, è negli ordinamenti di questi due Paesi che le inchieste sono state maggiormente utilizzate e hanno ricevuto una disciplina compiuta e organica. In Italia, invece, esse non hanno ancora trovato una larga applicazione, ma sono state guardate dal legislatore e dalla scienza giuridica via via con maggior interesse. L’analisi dell’istituto dell’inchiesta pubblica è articolata in tre parti. Nella prima, è trattato il modello di public inquiries operativo nel Regno Unito, con riferimento agli strumenti partecipativi nei procedimenti di localizzazione di opere pubbliche e nella formazione dei piani urbanistici. Nella seconda parte, è ricostruita la disciplina delle enquêtes publiques nel sistema amministrativo francese; la partecipazione ai procedimenti di pianificazione urbanistica, anche in questo caso, rappresenta una fattispecie paradigmatica per comprendere i tratti del modello. Nella terza, sono esaminate le disposizioni italiane rilevanti in materia d’inchiesta pubblica, con riguardo sia alla normativa nazionale che a quella regionale. Al termine dell’analisi, è effettuata una comparazione tra i tre sistemi, in modo da delineare i caratteri dell’istituto.
