The study focuses on assumptions about the distribution of income of partnerships in art. 5 of the Tax Code, with particular attention to their coordination with the statutory requirements in this area. The A. addresses the critical issues related to the allocation of income for transparency in case of takeover of a new partner, as well as those concerning the attribution of income in the event of dissolution of the interim report up to a social partner. The study therefore proposes a systematic interpretation of the provisions contained in art. 5 of the FCA, also highlighting the scope of some of these anti elusive and demonstrating how the current legislation is in substance consistent with the complex system of business income.
Lo studio si concentra sulle presunzioni in merito alla ripartizione dei redditi delle società di persone di cui all'art. 5 del Tuir, con particolare attenzione al loro coordinamento con le prescrizioni civilistiche in materia. L’A. affronta le criticità connesse con l'attribuzione del reddito per trasparenza in caso di subentro di un nuovo socio, nonché su quelle concernenti l'attribuzione del reddito infrannuale in caso di scioglimento del rapporto sociale limitatamente ad un socio. Lo studio propone pertanto una interpretazione sistematica delle disposizioni contenute nell'art. 5 del Tuir, evidenziando anche la portata anti elusiva di alcune di queste e dimostrando come l’attuale normativa risulti nella sostanza coerente con il complesso impianto del redditi di impresa.
