A century after the first "Codex Iuris canonici", this essay, focusing its reflection on the codifying experience of the Catholic Church and the dialogue with coeval legal systems, focuses on the relationship between canon law and juridical cultures. The analysis carried out has highlighted the specificity of the "sui generis" role played by the Church and its legal system in the evolution of Western legal culture. And this is a subject with multiple implications, whose relevance is evident in the eyes of legal science (and to some extent, of Western public opinion itself), in view of the growing and widespread interest in religious legal systems and their respective regulatory sources.
Ad un secolo dal primo ‘Codex Iuris canonici’, questo saggio, incentrando la riflessione sull’esperienza codificatoria della Chiesa cattolica in dialogo con i sistemi giuridici coevi, si sofferma sul rapporto intercorrente tra diritto canonico e culture giuridiche. Dall’analisi avviata, rileva la specificità del ruolo ‘sui generis’ giocato dalla Chiesa e dal suo sistema giuridico nell’evoluzione della cultura giuridica occidentale. Ed è questo un tema dalle molteplici implicazioni, la cui rilevanza risalta evidente agli occhi della scienza giuridica (ed in qualche misura, della stessa opinione pubblica occidentale), in considerazione del crescente e diffuso interesse per i sistemi giuridici religiosi e per le rispettive fonti normative
