Riflessioni in tema di recesso del socio da società consortile tra profili giuridici e valutativi

This paper, concerning the controversial issue about the existence of the right of liquidation in the event of withdrawal of a partner from the consortium, will investigate about the possibility to include, in some cases, an economic evaluation of the corresponding fee. The study, after a brief explanation of the strategic importance of consortium and consortium companies in the current phase of economic development, will deal with the matter in jurisprudential key as regards the coordination between the corporate norm and the consortium norm and, then, it will explore the issue from a business economic perspective, in order to reach a conclusion as possible, giving reasons for the position taken.
